Terms and Conditions for "Auto Warranty" Service

1. "Auto Warranty" is a product warranty registration service for My Sony Members. You can register warranty at the time of purchase for the products under this purchase order. The 3-month Extended Warranty will also applies to warranty registration made under Auto Warranty service.

2. If you purchase the product through Sony Store in Hong Kong, you can enjoy the "Auto Warranty" service. It is deemed as your consent to us for using your personal information to process the warranty registration and including such warranty record in your My Sony Member account.

3. This warranty registration made under Auto-Warranty service applies to all products under the purchase order in Sony Store, Online(Hong Kong), except any PlayStation © products, Sony Ericsson products, Sony Headphones and other accessories, or the products which have no warranty as stated in the relevant product webpage. No partial product registration is allowed.

4. We will take around 14 days to process the registration. The registration under this Auto Warranty service shall only be regarded as completed when you receive our email confirmation to your designated email account notifying its completion. If you do not receive such email notification with 14 days after registration, please contact our Customer Service Hotline 28335129.

The My Sony member service (the "Service") provides a variety of applications and services to its members.


The Service is offered to you under the following terms and conditions, along with any amendments thereto, and any operating rules or policies as prescribed by individual applications or such rules that may be published from time to time by Sony Corporation of Hong Kong (hereinafter referred to as "Sony HK") or any of its affiliates and/or subsidiary (hereinafter referred to as "Terms of Use"). Please read them carefully.


By completing the registration process, you are stating that you are at least 18 years of age or a minor with parental consent to use this service, that you are eligible to use the Service, and that you agree to be bound by all of the terms and conditions of these Terms of Use. Sony HK may in its sole discretion revise these Terms of Use at any time without notice to you by updating this posting, and you are advised to visit this page periodically to review the Terms of Use, since they are binding on you. Violation of any of these Terms of Use may result in the cancellation of your registration with or without notice or termination of your access to the Web Site (defined below), as well as legal action against you.


1. USER REGISTRATION, PASSWORD AND SECURITY

To use our Service, you must complete a registration form. You will select a password upon registration. At the time of registration and at various times when using any homepage under the name of Sony HK and/or Sony (hereinafter referred to as "Web Site"), you will be asked to provide Sony HK with personally identifiable information including, without limitation, your name, date of birth, gender, contact information, Hong Kong Identification or passport number, ICQ number, e-mail address, credit card details ("Information"). You must ensure that the Information you provide is accurate, true, current and complete. If this is not the case or Sony HK has reasonable grounds to suspect as such, Sony HK has the right to cancel your registration. You understand that any and all Information you provide us will be collected and may be used for the purposes of collecting data for identity ratification and records, sending you information about different products and services, maintaining contact lists for correspondence, compiling aggregate statistics on Web Site usage, processing your purchase orders and rendering services such as warranty and after sales services. For the above purposes Sony HK may share your Information with associated companies in the Sony group either in Hong Kong or overseas. To enable us to provide you with customised and personalised services, we use cookie files to store and track information about you when you visit the Web Site and this is done without you being aware that it is occurring. You acknowledge and agree that you are solely responsible for the form, content and accuracy of any material or the Information placed by you on the Web Site.

PARENTS: Parents are recommended to accompany your children when using the Service.


2. MEMBER PRIVACY / Sony HK'S PRIVACY POLICY STATEMENT

It is Sony HK's policy to respect the privacy of its users. You are aware that any Information supplied by you will be retained by Sony HK and will be accessible to the Sony HK's employees (including any employees of any holding, subsidiary or associated companies) and other persons or bodies corporate engaged by Sony HK for or in relation to any of the purposes listed above or to third parties as stated in the Privacy Policy Statement as set out hereinafter and you authorise Sony HK to disclose all or any part of the Information provided by you to such third parties. You agree that Sony HK may release your Information when such release is reasonably necessary to (i) comply with applicable law, (ii) enforce or apply the terms of any of our User agreements, (iii) protect the rights, property or interest of Sony HK or our users or (iv) in compliance with our Privacy Policy Statement. You further acknowledge that third parties to whom information supplied by you may be transferred in accordance with the aforesaid may be situated outside Hong Kong. You are aware of your rights under the Personal Data (Privacy) Ordinance to have access to your Information held by Sony HK, to request correction of your Information, to be informed of action taken in response to any such request and/or request that there be attached to your Information a statement which you can supply Sony HK relating to the fact that you have requested a correction. You agree to pay Sony HK the reasonable charges requested by Sony HK in relation to the time and attendances involved in complying with your request in this regard. Given the nature of the Internet, we cannot guarantee that the transmission of data is 100% secure. However, we shall take all practicable steps to ensure that any Information collected by us via the Web Site is safe and secure from third party interference. Once we have received such Information, we will maintain this Information according to our usual strict security and confidentiality standards.


3. CONTENT GUIDELINES AND MEMBER CONDUCT

As a condition of using the Service, you agree to abide by these Terms of Use and all local, state, national and international laws and regulations, that apply to you. You shall be solely responsible for all acts or omissions that occur under your account or password.

3.1 Content Guidelines and Prohibited Activity. In addition to complying with all applicable laws and regulations, you agree to adhere to Sony HK's Content Guidelines outlined below.
     
  3.1.1 No posting, transmitting, distributing, or linking to content that is unlawful, harassing, abusive, threatening, harmful, obscene, tortuous, libelous, defamatory, invasive of another's privacy, or otherwise objectionable or that threatens physical harm or create hatred to any other person, group, or yourself, including but not limited to: -
   
  • explicit, vulgar, obscene, or profane language;
  • sexually explicit images or pornographic content;
  • content derogatory of others' ethnicity, race, gender, sexual orientation, or socioeconomic status;
  • content containing or encouraging gratuitous violence;
  • content that constitutes or encourages illegal activity, such as violation of export control laws, counterfeit money or promotes gambling.
  3.1.2 No activity or link to a site that violates intellectual property laws or infringes any intellectual property or other proprietary rights, or any contractual or fiduciary rights, including but not limited to: -
   
  • infringing copyrights, trademarks, or patents;
  • violating trade secrets, rights of publicity, or other proprietary rights;
  • posting information used to circumvent manufacturer-installed copy-protect devices, including serial or registration numbers for software programs, or any type of cracker utilities;
  • copying or framing another's web page, in whole or in part, without consent; and
  • providing pirated music or links to such files.
  3.1.3 No posting, transmitting, distributing, or linking to content that is exploitative of minors (i.e. anyone under the age of 18).
  3.1.4 No activity or link to a site that may be used to obtain an unauthorized access, interfere with, disrupt or cause damage to the Service or the computer networks, systems or accounts of others, including but not limited to posting and/or spreading of viruses or software designed to create a virus or to do harm to the Service or its members, including but not limited to transmitting any material that contains any computer viruses, trojan horses, worms, time bombs, cancelbots, or any other harmful or deleterious programs.
  3.1.5 No posting, transmitting, distributing, or linking to content that harms national security or incites unlawful activity.
  3.1.6 No impersonating or representing Sony HK, Sony HK staff, or attempting to mislead others as to the identity of the sender or the origin of a message.
 
You agree that Sony HK may remove content, messages, or home pages or any part thereof that you have posted or created on the Service, or terminate your account when Sony HK believes, in its sole discretion, that you are engaged in any of the activities listed above, which are provided by way of example, and not as a limitation. If Sony HK in its discretion suspends or removes your registration, Sony HK will not return the removed pages to you.

You are solely responsible for your act and everything contained on your message and content. You may be held legally liable for the same and legally accountable if you are found to express unlawful material, including but not limited to defamatory comments or material protected by intellectual property laws.
     
3.2 Content Advisories

The opinions and views expressed by members in chat rooms, e-board, forums, home pages, and other areas of the site whatever the topic, do not reflect the view of Sony HK. Sony HK is not obliged to review, screen or edit content posted by its members in forums, on home pages or in other areas of the site. Nonetheless, Sony HK reserves the right but not the duty to monitor or remove any information transmitted or received through the Service, to terminate your account and use of the Service, or to remove any content that you have posted to or transmitted through the Service at any time, without notice, in Sony HK's sole discretion.

Sony HK advises you not to trade or make any investment decisions based in whole or in part on information obtained through Sony HK. Sony HK is not responsible for the accuracy or content of any information posted on the Service, and is not responsible for any trading or investment or other decisions that are made on the basis of such information.

You acknowledge Sony HK merely acts as agent and all gift products are not supplied or manufactured by Sony HK. You also acknowledge that Sony HK makes no warranty as to its fitness or use or that it is in accordance with the sample or description. Furthermore, Sony HK shall not be held liable in any way for any damages or loss as a result of such gift or product sent to or received or used by you.

Sony HK encourages you to bring violations of these Content Guidelines and Terms of Use to Sony HK's attention, although we do not guarantee any action based on such information.


4. TERMINATION

Any misuse of the Service may cause termination of your account. Sony HK reserves the right to delete all data in your account and bar any further access to such files, with or without cause at any time, for any reason or no reason, and/or to terminate your account and your use of the Service with or without cause at any time and effective immediately, without prior notice.


5. NO SPAM

Sony HK will immediately terminate any account that it believes, in its sole discretion, is transmitting or is otherwise connected with any junk mail, spam, chain letters, or other unsolicited bulk e-mail commercial or otherwise.


6. NO RESALE OF SERVICE

You agree not to resell the Service or use of or access of the Service.

7. INDEMNIFICATION

You agree to indemnify, defend and hold harmless Sony HK and its parents, subsidiaries, affiliates, officers, and employees from any loss, liability, claim, demand, damage, or expenses (including reasonable attorney's fees) asserted by any third party due to or arising from or in connection with your use of or conduct on the Service, content appearing on your home page, or messages posted or transmitted by you on or through the Service or reserves the right, at its own expenses, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, which shall not excuse your indemnity obligations.


8. MODIFICATIONS TO TERMS OF USE OR TO THE SERVICE

Sony HK reserves the right to change the Content Guidelines and Terms of Use at any time without notice. Sony HK also reserves the right to modify or discontinue the Service, temporarily or permanently, with or without notice to you. You agree that Sony HK shall not be liable to you or any third party for any modification to or discontinuance of the Service.


9. YOUR PROPERTY RIGHTS

You agree that upon posting information on the Service, you grant Sony HK, and its successors and assigns, a non-exclusive, worldwide, royalty free, perpetual, non-revocable license under your copyrights or other intellectual property rights, if any, in such material, to use, distribute, display, reproduce, and create derivative works from such material in any and all media, in any manner, in whole or part, without any duty to account to you. You also grant Sony HK the right to authorize the downloading and printing of such material, or any portion thereof, by end users for their personal use.


10. Sony HK PROPRIETARY RIGHTS

The contents of the Web Site, such as text, graphics, images, music, logos, button icons, links, HTML code, trademarks, software and other material (collectively hereinafter referred to as "Materials") and the compilation (meaning the collection, arrangement and assembly) of all Materials on the Web Site are protected under copyright, trademark and other applicable laws. All Materials and compilation thereof is the exclusive property of Sony HK or its content suppliers or clients. Unauthorised use of any of the Materials may violate copyright, trademark, and other applicable laws. You acknowledge that any content you received through the Service may be displayed, reformatted, and printed by you for your personal, non-commercial use only. You agree not to modify, copy, reproduce, republish, upload, post, transmit, sell or distribute in any way content available through the Service, including code and software or otherwise use the Materials in any way without the Sony HK's prior written consent and for any public or commercial purpose.


11. EXTERNAL LINKS

The Service may contain links to other Internet sites, resource and members of the Service. We are not responsible for the availability of these outside resources, or their contents, nor do we endorse nor are we responsible for any of the contents, advertising, products or other material on such sites. Under no circumstances shall we be held responsible or liable, directly or indirectly, for any loss or damages caused or alleged to have been caused by your use of or reliance on any content, goods or service available on such sites. Any concerns regarding any external link should be directed to its responsible site administrator or webmaster.


12. MERCHANDISE

All merchandise, products or services (hereinafter collectively referred to as "Merchandise") offered, introduced or mentioned, unless otherwise stated, are provided by third parties other than the Web Site. You make no reliance whatsoever on us regarding the accuracy or reliability of any of the information that may be provided in the Web Site concerning such Merchandise. We cannot, and do not make any representations or warranties as to the security of any Information that you might be requested to give to such third party. You are strongly encouraged to make whatever investigation you feel necessary or appropriate before proceeding with any on-line or off-line transaction with any of these third parties. To the maximum extent permitted by law, we DISCLAIM all representations and warranties, express or implied, with respect to merchantability, fitness for a particular purpose, any implied warranties arising from course of performance or course of conduct in relation to the Merchandise. Sony HK does not control in any respect any information, products or services offered by third parties on the Service. You expressly agree that use of the Service is at your sole risk.

Sony HK is not responsible for the content of e-mail messages distributed through the Service, content appearing on its members' home pages, or other content posted by its members, and assumes no responsibility for and makes not warranty or representation as to the accuracy, currency, completeness, reliability or usefulness of information distributed by others through the Service.

To the fullest extent permitted by applicable law, Sony HK expressly disclaims all warranties and conditions of any kind, whether express or implied, including but not limited to, implied warranties of merchantability and fitness for a particular purpose. Sony HK makes no warranty that the Service will meet your requirements, nor that the Service will be uninterrupted, timely secure or error free. Sony HK makes no warranty as to the use of the results that may be obtained from the use of the Service or makes no warranty that defects in the software will be corrected or that this site or the server that makes it available is free of viruses or other harmful components. Sony HK disclaims any warranty or representation that confidentiality of information transmitted through the Service will be maintained.

Sony HK makes no warranty that language translations provided through the Service will be accurate or complete.
Sony HK makes no warranty regarding any goods or services or the delivery of any goods or services or the delivery of any goods or services purchased or obtain through the Service or advertised through its supplier's sponsors or advertisers, or regarding any transactions entered into through the Service.

No advice or information, whether oral or written, obtained by you from Sony HK or through or from the service shall create any warranty not expressly stated herein.


14. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, under no circumstances, including, but not limited to, negligence, shall Sony HK be liable for any direct, indirect, incidental, special or consequential damages, resulting from the use or the inability to use the Service, from the cost of procurement of substitute goods and services, from any goods or services purchased or obtained or messages received or transactions entered into through or from the Service or from unauthorized access to or alteration of your transmissions or data, including but not limited to damages for loss of profits, use, data or other intangibles, even if Sony HK has been advised of the possibility of such damages.

You specifically agree that Sony HK is not responsible or liable to you or anyone else for any threatening, defamatory, obscene, offensive or illegal conduct of any other party or any infringement of another's rights, including intellectual property rights, occurring on or through or related to the Service. If you are dissatisfied with the Service, the materials available on or through the Service, or with any of Sony HK's content guidelines or terms of use, your sole and exclusive remedy is to discontinue using the Service of Sony HK.
You agree that Sony HK is not responsible for any loss of data resulting from our deletion of your home page or other content of the site from network or systems outages, from file corruption or any other reason.
You further agree that Sony HK shall not be liable for any damages arising from interruption, suspension or termination of service, including but not limited to direct, indirect, incidental, special, consequential or exemplary damages, whether such interruption, suspension or termination was justified or not, negligent or intentional, inadvertent or advertent.

Some jurisdictions do not allow the limitation of exclusion of certain warranties, conditions, and/or liability for some types of damages, so some of the above exclusions may not apply to you.


15. DEALINGS WITH ADVERTISERS

Your correspondence or business dealings with, or participation in promotions of, advertisers found on or through the Web Site, including payment and delivery of related goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such advertiser. You agree that Sony HK shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of the presence of such advertisers on the Web Site.


16. MISCELLANEOUS

The failure of Sony HK to exercise or enforce an y right or provision of the Terms of Use shall not constitute a waiver of such right or provision. If any provision of the Terms of Use is found by a court of competent jurisdiction to be invalid or contrary to law, then such provision(s) shall be constituted, as nearly as possible, to reflect the parties' intentions, and the other provisions of the Terms of Use shall remain in full force and effect.

You agree that regardless of any statute or laws to the contrary, any claim or cause of action arising out of or related to use of the Service or to the Terms of Use must be commenced within one (1) year after such claim or cause of action arose or be forever barred.

The section titles in the Terms of Use are for convenience only and have no legal or contractual effect or significance.


17. FURTHER RULES

Each individual game or service of the Service may contain other by-laws/regulations on top of the above rules and you are required to go through it before you participate in such games/service.
